Data processing agreement

1. The parties

This agreement binds the business using Klienix (the controller, "you") and [to be completed] (Klienix, the processor). It is part of the terms of service, accepted when the account is created.

2. Purpose and duration

Klienix processes your clients' and prospects' data to run the service: business page, automatic replies, texts, emails, calls, campaigns, job files, reviews and referrals. The agreement lasts as long as your account.

3. Data and people concerned

• People: your clients, your prospects, people who call or write to you, your referral partners.
• Data: first name, last name, phone, email, requests, messages, calls and voicemails with their transcript, job files, photos, amounts, contact preferences.
• Klienix is not designed for sensitive data (health, opinions, bank details). Do not enter them in notes or messages.

4. What Klienix commits to

• Process the data only for you and on your instructions, given through your settings in the app.
• Keep the data confidential: only people who need it to run the service can access it, and they are bound to confidentiality.
• Protect the data: encrypted connection, encrypted passwords, strict separation between businesses, nightly backups, database in the European Union.
• Help you answer your clients' requests: export, correction and erasure of a client in one click, automatic unsubscribe by STOP or by link.
• Notify you without delay, and at the latest 48 hours after becoming aware of it, of any data breach affecting you, with the information needed to notify the CNIL.
• Assist you if an impact assessment or a consultation with the CNIL is needed.
• Make available the information that shows compliance with this agreement, and answer your audit questions.

5. Klienix providers (sub-processors)

You authorize Klienix to use the providers below. Each one is bound by protection obligations at least equivalent. Klienix notifies you by email 30 days before adding or changing one: you can then object and close your account at no cost.

Transfers outside the European Union are covered by the European Commission's standard contractual clauses and, where the provider is certified, by the Data Privacy Framework.

6. What you commit to

• Only import or add people who are your clients or who have given you their consent.
• Only send offers to a prospect (someone who has never bought) if they accepted them. Klienix applies this rule automatically to requests from your page.
• Inform your clients about how their data is used. Klienix shows a notice on your page, in every email and at the start of every call.
• Answer your clients' requests (access, erasure, objection) with the tools provided.

7. End of the contract

You can download all your data at any time (Settings, My data). When the account is closed, all data is erased immediately; backup copies disappear within 30 days. An inactive account without a subscription is erased 12 months after the trial or subscription ends.
